SOUTHAMPTON, Pa.--March 1, 2004--Stefan Keller, president of Truescreen, recently spoke on managing employee screening privacy and security issues at the ASIS Emerging Trends in Security Practice & Technology Conference.
Keller's presentation, "How to Balance Emerging Security and Privacy Laws Surrounding Background Checks and Drug Tests," highlighted how to resolve potential conflicts created by new security laws that mandate employee screening activity, and new privacy laws that restrict access to personal information.
The presentation focused on federal security legislation including the USA Patriot Act, the Terrorist Financing Executive Order signed in 2001, the Sarbanes-Oxley Act of 2002, and a number of new state laws mandating background checks and other screening requirements.
It also examined federal privacy legislation including HIPAA, the Gramm Leach Bliley Financial Services Modernization Act, the Drivers Privacy Protection Act, and several new state laws that establish restrictions for employee screening processes or access to personal information.
Attendees learned how to balance these conflicts, through proper use of release authorizations, employment applications, interviewing methods, and other tactics to achieve both security and privacy compliance, and still maintain an effective employee screening program.
