News Release: Executive Order Requires Government Contractors to Use E-Verify

President George W. Bush has signed an amendment to an Executive Order that requires all federal contractors to use E-Verify to determine workers’ employment eligibility. The requirement is expected to take effect in the next several weeks and could affect millions of federal contract workers.

E-Verify (formerly known as Basic Pilot) is an online system that allows an employer to determine a new hire’s eligibility to work in the U.S. by comparing the information provided on the I-9 form to Department of Homeland Security (DHS) and Social Security Administration (SSA) databases. Previously, E-Verify was voluntary for private employers, but now, any employer with a federal government contract, including those with federal departments and agencies, will be required to participate. Eight states also require certain employers to use the E-Verify system.
