Washington Rule Clarifies Background Check Requirements for Long-Term Care Workers
Effective August 11, 2024, Washington's new rule updates and clarifies background check procedures for long-term care workers, aligning state rules with federal requirements and recent legislative changes under SB 5252.
The rule outlines specific requirements for long-term care workers employed by home care agencies licensed by the Department of Health and residential habilitation center (RHC) employees.
New Hires:
- National fingerprint-based background check
- Washington state name and date of birth check
Renewals (required at least every 36 months:
- Washington state name and date of birth check
- If the employee has lived outside Washington during the 36 months, a national fingerprint-based background check is also required
Job Class Changes:
- Background check renewal, including a fingerprint check, regardless of residency status
Employers providing services to individuals with developmental disabilities in Washington should review these updates to ensure their background check programs remain compliant.
