Connecticut Broadens "Clean Slate" Rules for Criminal History Inquiries

Signed into law by Governor Ned Lamont in June 2021, Connecticut's "Clean Slate" law will take effect on January 1, 2023.

Beginning January 1, 2023, new criminal background check rules in Connecticut will restrict employers from seeking information regarding an expanded definition of "erased criminal history information" at any step of the application process. "Erased Criminal History Information" may include:

  • Any erased records;
  • Information relating to persons granted youthful offender status; and
  • Continuances of a criminal case that are more than thirteen months old.

Employers must also include a standard notice to the employee in clear and conspicuous language, indicating that they are not required to disclose criminal history that falls into the above categories.

Employers are reminded of existing law in Connecticut, which restricts public and private employers from inquiring about prospective employees' past convictions until they are otherwise deemed qualified for the position. Employers may inquire about criminal background information in subsequent steps after the initial employment application.
