Plaintiffs in the class action lawsuit claimed that O'Reilly violated the Fair Credit Reporting Act (FCRA) by allegedly including extraneous information on its disclosure forms. The FCRA is clear in stating that these forms need to be clear "stand-alone" documents and not mixed in with other forms or information.

Members of the class action suit include individuals who signed O'Reilly's disclosure, authorization and digital signature forms and for whom the company procured a consumer report between January 31, 2015, and February 17, 2021.

Class members can receive an equal share of the net settlement which is currently estimated at $2.92.

The deadline for exclusion and objection was March 5, 2023 and the final approval hearing was set for March 6, 2023.
