Illinois Clarifies New E-Verify Regulation
E-Verify use is not prohibited for employers after January 1, 2025
On August 9, 2024, Illinois Governor J.B. Pritzker signed Senate Bill 0508 into law. This law contains numerous amendments to the Illinois Right to Privacy in the Workplace Act related to E-Verify use, effective January 1, 2025. These amendments, and a primer on how to achieve compliance with new requirements using the i9Success system, will be the subject of a forthcoming i9Success publication.
Many outlets have claimed that the amendments prevent any E-Verify participation by Illinois companies (either headquartered in, or having an office/employee in Illinois).
Earlier today, the Illinois Department of Labor released a fact sheet clarifying that E-Verify use is not prohibited under these recent amendments. Specifically "Illinois law does not prohibit any employer from using E-Verify. However, employers who use E-Verify must follow the requirements of the 'Right to Privacy in the Workplace Act.'"
